Terms and Conditions of Use

Welcome to Rockbalm Health. These Terms and Conditions (“Terms”) govern your use of our website (www.rockbalmhealth.com), our web application, and the services provided by Rockbalm Health, including home-visit care, telecare, and our pharmaceutical store.

By accessing our platform or using our services, you agree to be bound by these Terms. If you are using this platform on behalf of a senior (the “Patient”), you represent that you have the legal authority to act on their behalf.

1. Services Provided

Rockbalm Health provides a bridge for geriatric care through:

  • The Seniors Store: An online pharmacy and medical device outlet.
  • Home-Visit Services: Medical, pharmaceutical, and nutritional consultations conducted at the patient's residence.
  • Telecare: Virtual consultations and health monitoring.

2. Pharmaceutical Services & Prescriptions

  • Verification: We will not dispense any Prescription-Only Medicine (POM) without a valid prescription verified by our Superintendent Pharmacist.
  • Right to Refuse: Rockbalm Health reserves the right to refuse to dispense any medication if our pharmacist determines it is not in the best interest of the patient’s safety or if the prescription's authenticity is in doubt.
  • Substitution: In line with professional practice, we may offer NAFDAC-approved generic equivalents of prescribed medications where appropriate, subject to your consent.

3. Home-Visit & Telecare Appointments

  • Environment: For home visits, you agree to provide a safe and professional environment for our clinical staff.
  • Cancellations: Appointments must be cancelled at least 48 hours in advance to be eligible for a full refund or rescheduling.
  • Limitations: Telecare and home visits are not for emergency life-threatening situations. In an emergency, please contact the nearest hospital emergency department immediately.

4. User Accounts & Accuracy

  • Information Accuracy: You are responsible for providing accurate health history for the senior. Rockbalm Health is not liable for adverse outcomes resulting from withheld or incorrect medical information.
  • Account Security: You are responsible for maintaining the confidentiality of your login credentials.

5. Payments, Fees, and Refunds

  • Pricing: All prices are in Nigerian Naira (NGN). We reserve the right to adjust pricing based on market changes or NAFDAC-regulated adjustments.
  • Refund Policy (Medications): Due to health and safety regulations, dispensed medications cannot be returned or refunded once they have left our pharmacy premise, except in cases of proven manufacturer defect.
  • Refund Policy (Services): Refunds for unused subscription plans or cancelled visits are processed within 5 business days.

6. Limitation of Liability

Rockbalm Health and its clinical staff act in accordance with the professional standards of the Medical and Dental Council of Nigeria (MDCN) and the Pharmacy Council of Nigeria (PCN). However, Rockbalm Health shall not be held liable for:

  • Technical Interruptions: Technical interruptions of the web app.
  • Delayed Deliveries: Delayed deliveries due to unforeseen logistics or traffic conditions in Nigeria.
  • Adverse Reactions: Adverse reactions to medications correctly dispensed according to a valid prescription.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Nigeria.

8. Modifications

We reserve the right to update these Terms at any time. Continued use of the platform after changes are posted constitutes your acceptance of the new Terms.
